After the Civil War, several amendments were passed in order to protect the rights of the previously enslaved African Americans.

The Southern States however, found loopholes to exploit that allowed them to exclude blacks from certain aspects of live. Congress therefore passed the Civil Rights Act of 1875 which:

  • was to protect the rights of all citizens
  • was to give all citizens equal treatment in public facilities

The Supreme Court however struck most of it down by saying that Congress could not, under the Equal Protection clause of the 14th Amendment, control the activities of private parties.

In conclusion, the Civil Rights law was struck down by the Supreme Court using an Amendment that was supposed to protect African Americans.
