A process that allowed for slavery to be re-initiated in all but name was the arrest of Black people under the Black Codes.

What did the Black Codes do?

  • They allowed for the arrest of Black people for arbitrary reasons.
  • They resulted in many Black people being sent off to jail.

When Black people were put in jail, the state would then use them for labor in the fields at a very low rate. This therefore brought back slavery in some form that was legal under the 13th Amendment.
