What is judicial restraint?

This is the term that has to do with the use of procedures and other approaches in a judicial review. It has to do with the fact that a judge would exercise caution when interpreting the constitution. In this situation when the judge is interpreting the constitution, they would have to be in favor of the Status quo. That is what already exists.

When this is in play in the court of law, a judge would be very hesitant to turn down a law. He would only do this if it is obviously seen to be inconsistent with the existing law.

This would be done in a way that they would not have to put in their own views. Hence  The characteristics of a judicial restraint would be basing decisions on previous decisions.
