preparing for the final contest to become the winner for the new season
2017. Sally intended to engage a professional tailor to sew the dress suitable
for the contest. Sally consulted Robin, a well-known fashion designer in
town on the choice of fabric for the dress because she had sensitive skin
and would be allergy to certain types of fabric. Sally also paid RM3,000 for
the cost of the dress. After the contest, Sally discovered red spots on her skin.
Sally went to see the doctor and she was told that her skin was sensitive to
the fabric used for the dress that she worn for the contest. Sally went to see
Robin and returned the dress for the reason that the fabric used for the
dress was not fit for the purpose she made known to Robin and caused her
skin complaint. Explain whether Sally can claim for the refund of her
money from Robin being the cost of the dress and the medical expenses
incurred by her.
