I believe it would be a civil court because it is a personal claim against someone. Civil courts do not deal with criminal cases.

He didn't commit an offense that is punishable by criminal law. You should go to a civil court where you can sue them for fraud or for malpractice or anything similar that your attorney might advise you. Civil courts only deal with things between people and in this case you and the contractor both consider yourselves to be right so you'd have to prove who is right in court.
